THIS AGREEMENT comes into effect upon the User using the products of Ausfarm Online Pty. Ltd ("Ausfarm Online") AND in consideration of this use both parties agree to abide by the Terms and Conditions set out by Ausfarm Online and the User agrees to pay the fees of Ausfarm Online set out on the Rate Card contained therein.

In these terms and conditions, "We" "Us" and "Our" refers to Ausfarm Online Pty Ltd. "You" "Your" refers to you, the user. This Website is owned and operated by Ausfarm Online Pty Ltd under the domain name www.ausfarmonline.com.au". Any reference to the "Website" refers to the Ausfarm Online Website, www.ausfarmonline.com.au. We reserve the right to amend this Notice at any time and Your use of the Website following any amendments will represent Your agreement to be bound by these terms and conditions as amended. We therefore recommend that each time You access our Website and You read these terms and conditions. Your use of the services, information, text, graphics, materials and other content on the Website is governed by these Terms and Conditions. By using this Website you agree to be bound by these Terms and Conditions. When You register Your details and place an offer on the Ausfarm Online Website, You accept all aspects outlined in the Ausfarm Online Site's "Terms and Conditions". Your use of this Website (for both registered and unregistered users) indicates your agreement to be bound by the Terms of use.
Ausfarm Online's Obligations
Ausfarm Online Pty. Ltd's role is only that of facilitation and has no obligation in any form, to any person / entity placing an offer or registering an interest in any offer on the Website. We provide an information platform for both registered and unregistered users.
Limitation of Liability
Subject to any responsibilities implied by law and which cannot be excluded, Ausfarm Online Pty Ltd and its directors, employees, agents and contractors, are not liable to You for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defense or settlement costs) whatsoever, whether direct, indirect or consequential, arising out of or referable to material on this Website or linked Websites, third party services, or to access of the Website by You, howsoever caused, whether in contract or tort including negligence, statute or otherwise.
Fees
All fees and charges related to any sales are listed on the "Rate Card", please refer to the link on the Website Homepage. All prices are in Australian Dollars (AUD) and are exclusive of GST. Fees and prices are subject to change. If You use the site to promote an advertisement or listing on the Website, the Terms and Conditions for the relevant item will also apply. Please read and agree with those Terms and Conditions at the time of uploading your listing. Each Term equals 31 days unless stated otherwise.
Refund Policy
You can request a refund for any unused pre-bought Term/s providing Ausfarm Online is in agreement with the request. Please speak to an Ausfarm Online employee on 03 5744 3782, or email info@ausfamonline.com.au or send your request in writing to Ausfarm Online, PO Box 510, Yarrawonga, VIC, 3730 to be assessed.
Pricing on the advertisements
All prices provided and set on the Website are the responsibility of the third party advertisers publishing the item. Ausfarm Online provides a platform only for the seller and buyer and will not be responsible or drawn into any negotiations or disputes as a result of the listing. Ausfarm Online does not guarantee the accuracy of pricing information on the Website. No preferential treatment will be given to is given particular companies over others.
Use of the Website
Material contained on the Website is supplied solely for reference purposes You agree that You will not: disrupt or interfere with the Website, or any services, system resources, accounts, servers or networks connected to or accessible through this Website or Linked Websites; disrupt or interfere with any other user's enjoyment of this Website or Linked Websites; take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Website; use any device, software or routine to interfere or attempt to interfere with the proper working of the Website or any transaction or process being conducted on or through it; use any robot, spider, metatags, other automatic device or manual process to monitor or data mine, alter, modify, any Web pages on the Website, or any of the content contained within.
Our Rights
Ausfarm Online Pty. Ltd reserves the right to suspend or terminate Your registration without notice if We suspect that You have engaged in fraudulent activity in connection with our Website, or if You post offensive or inappropriate message or content on the Website. We may withdraw or alter any material you provide us (including any content you submit and if you are a seller, your ad) if:
(a) we reasonably consider it is inappropriate, offensive, misleading or deceptive, defamatory, incorrect or in any other way in breach of the Terms (including any rules, guidelines or policies), any law or third party rights; or
(b) we are instructed to do so by any third party.
While it will not be Our practice to manage or change the content of the listings or Business Pages, (internal hyperlinked pages on the Website that are managed by External Businesses) we reserve the right to edit or remove any information deemed to be inappropriate, offensive, misleading or deceptive or defamatory. We do not need to provide You with a reason for doing this.
Warranties
Whilst reasonable steps have been undertaken to ensure that information is free from error, Ausfarm Online Pty Ltd does not warrant the accuracy, adequacy or completeness of material on the Website. All information is subject to change without notice. We do not warrant or represent that our services and/or your access to the Website will be continuous, uninterrupted, timely, fault free, virus free or secure, due to numerous factors outside our control (such as malfunction in equipment or software, difficulties accessing the Internet, or delay or failure of transmission. Website may also contain hyperlinks to other external Websites, which are owned or operated by third parties independent of Ausfarm Online Pty Ltd. We do not sponsor, endorse or approve of the operators of these sites, or the material they display. We make no warranties with respect to these sites. We do not manage, nor take responsibility for the content, nor take responsibility of the linked Business Pages sites and the information supplied may not be accurate. If you link to any third party site, you do so entirely at your own risk.
Indemnity
You indemnify Ausfarm Online Pty Ltd in respect of any liability incurred by Us for any loss or damage, howsoever caused, suffered by Ausfarm Online Pty Ltd as a result of Your breach of these Website Terms and Conditions, or Your use of the Website.
Copyright and Trademarks
We do allow you to share copy providing that you reference Ausfarm Online as your source. You must abide by the regulations set out in the TRADE MARKS ACT 1995.
General
The law applicable to the Website and to disputes arising out of the Website is the law of the State of Victoria, Australia.
Should any clause or part thereof of these Terms and Conditions be found to be void, unenforceable or invalid, then it is severed from this agreement, leaving the remainder in full force and effect, provided that the severance has not altered the basic nature of this agreement.
Any comment, feedback, idea or suggestions that You provide to Us through this Website becomes our property. If in future We use any of Your material in promoting our Website or in any other way, We will not be liable for any similarities which may appear from such use. Furthermore, You agree that We are entitled to use any comments or feedback for any commercial or non-commercial purpose without compensation to You or to any other person who has transmitted Your Comments.
If You provide Us with material, You acknowledge that You are responsible for the content of such material including its legality, originality and copyright.
Rules for placing ads/tenders etc
Placing an advertisement in the Rural Classifieds or Contractors Corner
If you place an advertisement in the Rural Classifieds or Contractors Corner you must also comply with out Terms and Conditions.
Ausfarm Online is an Agricultural based website therefore all content must be Agricultural related. We reserve the right to remove any advertisements that we deem to be non-Agricultural related. Your Content in any other directory, product, service or marketing material provided or used by Us, our related bodies corporate or by a third party to which we syndicate Your ad or Your Content. You agree that this agreement applies to the inclusion of Your Content in those other directories, products, services and marketing materials. Freight Finder Ausfarm Online Pty Ltd does not screen or qualify transport operators for compliance with federal, state or local laws and regulations. It is recommended that You confirm such compliance directly with the transport operator before services are rendered by the transport operator. Transport Operators must comply by all federal, state and local government legislation. This includes complying with all Chain of Responsibility (CoR) laws. The transport operator must also legally able to transport the loads that they accept from this Website. Including, if required, appropriate licensing and registration with federal, state and local government authorities. Ausfarm Online Pty Ltd is not responsible for any breaches of (CoR) or for ensuring transport operators are legally able to transport loads that they move. We have no control over the quality, safety, or legality of the transactions that take place on our Website, the accuracy of our listings, the ability of transport operators to transport items, or the ability of clients moving freight to send items. We cannot ensure that a transport operator or client with freight to move will actually complete a shipment. Product Tender Businesses who have paid and registered have the right to communicate with the person/s who listed the product, via our register, but not directly. The person registering the product/s to be tendered may communicate directly with the Business who has responded to the Tender. We expect that both parties involved in the potential business transaction abide by the rules set out and that Ausfarm Online has no direct responsibility for any outcomes.

Each Tender listing will run for 4 working days, or unless the Tender is removed by the Buyer

Rules
For the Business Tendering for the Product
You take full responsibility for providing accurate details regarding the Tender and that you fulfil any requirements agreed on your Tender bid. As stated in the Terms and Conditions, Ausfarm Online will not take any responsibility for any actions or outcomes involving Product Tender.
For the Person/s submitting the Tender.
We expect you to honour any agreements made with the Business. As stated in the Terms and Conditions, Ausfarm Online will not take any responsibility for any actions or outcomes involving Product Tender. Purple Pages Purple Pages will only be offered to registered business
who have purchased an Ausfarm Online Products. The advertisement will be managed by Ausfarm Online. Just-In To post a message on Justin you must be a Registered user with Ausfarm Online. Ausfarm Online reserves the right to remove your Justin post if we deem the content offensive, which will be at our discretion. We do not need to contact you before removing postings. In extreme cases we may remove your Registration. Calendar of Events Only Registered users can list their events on the Ausfarm Online Calendar. Listings will be removed when the event date has passed. Dealers/Traders, Agents Registered businesses can purchase an internal hyperlinked page/s on the Website that are managed by External Businesses, called "Business Pages". All pages are content managed by the Registered Business. Sales-Auctions Any Sales advertisement will be displayed for up to 14 days, unless it is a Clearing Sale, which will be displayed for 62 days (2 Terms).
Forward Listing
Advertisements can be placed up to 12 months in advance. Advertisements will be removed 31 days prior to the expiry date.
